This paper deals with the question of the extent to which the current legal structure opens up opportunities for the possibility of creating more flexibility of the statutory pension insurance system. To this end, the term “flexibility” is first defined. In the following, the constitutional scope for a possibility of creating more flexibility is examined in detail. In particular, the protection of the ownership of pension law positions is analyzed. Finally, it is examined where the current system opens up points of contact for the possibility of creating more flexibility.
